These Terms of Service ("Terms") govern your access to and use of the TownDesk platform, consoles, embeds, and the towndesk.us website (together, the "Service"), provided by TownDesk ("we," "us"). By using the Service you agree to these Terms. If you are using the Service on behalf of a town or organization, you represent that you are authorized to accept these Terms on its behalf.
The service
TownDesk provides software for municipalities to receive and track citizen requests, manage records and meetings, notify residents, and related functions. We may improve or change features over time; we won't materially reduce a paid town's core functionality without notice.
Accounts & access
Town staff accounts are for authorized individuals only. You are responsible for safeguarding sign-in credentials and for activity under your account. Staff sign-in requires multi-factor authentication in production.
Acceptable use
You agree not to:
- use the Service unlawfully or to violate others' rights;
- upload malicious code, attempt to breach security, or disrupt the Service;
- misuse resident data or attempt to re-identify or publicly expose reporter identities protected by the Service;
- resell or provide access to the Service except as permitted by your agreement with us.
YouTube-transcript feature
The optional meeting-transcript feature uses YouTube API Services. If you use it, you also agree to be bound by the YouTube Terms of Service, and your use of Google/YouTube data is subject to the Google Privacy Policy. See our Privacy Policy for what we access and how to revoke access.
Your data & ownership
A town's data is the town's own. We handle it as described in our Privacy Policy. You can export your data at any time in a standard format — no lock-in, no export fee. We claim no ownership of your content.
Availability & disclaimers
We work hard to keep the Service reliable and secure, but it is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. The Service is a tool to assist town operations; it is not legal advice, and towns remain responsible for their own legal and open-records obligations.
Limitation of liability
To the fullest extent permitted by law, TownDesk will not be liable for indirect, incidental, or consequential damages, or for amounts exceeding the fees paid for the Service in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Termination
You may stop using the Service at any time; there is no multi-year lock-in. We may suspend or terminate access for violations of these Terms or as required by law, and will give a paying town a reasonable opportunity to export its data.
Changes
We may update these Terms; we'll revise the effective date and, for material changes, notify the towns we serve. Continued use after changes take effect means you accept them.
